Thankfully, the Texas Family Code Section 143.432 recognizes the rights of both biological and adoptive grandparents to access to their grandchildren.
Access to Grandchildren: The Legal Process
The process of gaining access may require taking legal action. To request visitation through the family court system, a legal action may be necessary, called “Suit Affecting the Parent-Child Relationship.” To have the right to visit with your grandchildren, only one parent is required to give permission if the visit occurs during the time when that parent is caring for the child. In some cases, the grandparents may have concerns about a child’s welfare.
